An initiative petition to restore more favorable rooftop solar rates will not be on the November ballot.

The Nevada State Supreme Court upheld a lower court ruling which disqualified the initiative. It was Question 5 on the ballot and sponsored by rooftop solar companies like Solar City.

NV Energy spent more than $1 million opposing the initiative.

The justices ruled that the solar companies went about it the wrong way. They should have filed an initiative petition which asks voters to approve a new law rather than a ballot referendum asking voters to weigh in on an existing one.
