Man accused of killing 3-year-old appears in court

A man accused of killing a 3-year-old boy returned to court Monday morning.

Forty-year-old Joshua Oxford and his girlfriend Cassie Smith face murder charges for Daniel Theriot’s death.

Oxford was a ‘no show’ to court on Friday.  His attorney tells 8 News Now that he was sick.

Judge Melanie Tobiassian did say Oxford would be in court Monday by any means necessary and he was. Oxford’s appearance was brief.

He told Judge Tobiasson that he understood the charges against him. This appearance was for Theriot’s murder.

His mother, Cassie Smith, originally told police Theriot disappeared at Sunset park last Sunday. This sparked a large search and rescue operation in and around the park.

The little boy’s body was found in a remote area near Lake Mead, last Monday.

Police and the coroner have yet to release how Theriot died. They did say they found his brother, 2-year-old Brandon Smith and that he had signs of physical abuse.

Smith and Oxford face child abuse charges for Smith as well as first degree murder charges for Theriot.

Oxford is scheduled to return to court on the murder charge on Nov. 26.

Cassie Smith is expected back in court for a preliminary hearing on the murder charges Sept. 20.
