He told 8 News Now over the phone that he plans to travel to Las Vegas to take his son’s body back to Texas as well as get custody of his surviving 2-year-old boy, who police say was also found with signs of physical abuse.

Theriot’s family friend spoke with 8 News Now.

“It’s very sad that somebody would actually think about doing that to a baby. I could never imagine somebody doing that to a 3-year-old, especially. It’s just — that kills me,” said Miranda Wortham.

Theriot says he’s having a hard time getting a hold of Child Protective Services and no one has reached out to him.

He says his son Daniel will always be remembered as loving and compassionate and he wants Cassie Smith and Joshua Oxford to spend the rest of their lives in prison.

They are expected to be charged in the boy’s death.
