Bail was set at $100,000 for the the man and woman who were arrested following the discovery of a 3-year-old’s body in a remote area near Lake Mead

Cassie Smith, 20, the mother of Daniel Theriot, and her 40-year-old boyfriend, Joshua Oxford made their initial appearance in a Las Vegas courtroom Tuesday.

The defense attorney for Oxford sought a bail of $5,000 far less than what was sought by the prosecutor.

“We would ask for bail to be set at $200,000 and not $5,000.

“This is a person who has been convicted previously of endangering and abusing a child and now under his care a child has died,” prosecutor Brandon Albright said.

They are currently facing child abuse charges for Daniel’s younger brother. They will also face additional charges for Daniel and are expected in court again Wednesday at 8 a.m.

The prosecutor said Daniel’s body had notable bruises and burns marks consistent with abuse.

This was today’s hearing. (Their case starts at 26:50)
