The I-Team has learned the retrial for personal injury attorney Noel Gage will be delayed. Gage is on trial for his part in a conspiracy involving prominent doctors and lawyers to defraud personal injury clients and spread the money among themselves.
Gage's first trial ended in a hung jury and Wednesday the judge issued an order striking the May 27 retrial date.
A new date will be scheduled if the judge doesn't throw out the case, which he has threatened to do if the government does not offer immunity to defense witness Dr. Mark Kabins.
The government refused, saying Kabins is one of the main players in the conspiracy and may be indicted in the future.
