Defense in HOA Case Seeks Trial Delay

LAS VEGAS -- Defense lawyers are seeking to delay the start of a federal case involving a former construction boss and five other defendants accused of wrongdoing in the operation of Las Vegas Valley homeowners' associations, but a magistrate judge Monday said the motion would be more appropriately decided by the trial judge. 

Leon Benzer and the other defendants were indicted after a federal probe allegedly showed they took control of HOAs and then steered work to favored attorneys and businesses.

At issue are 87,000 pages of documents from prosecutors that the defense team wants loaded onto computer discs for research purposes.

The defendants are set to go to trial in October, but the defense would like to see a delay until sometime next year. Federal Magistrate Judge George Foley heard the motion Monday to delay the trial but suggested that the matter be considered instead by U.S. District Judge James Mahan, the trial judge.
