Nevada Same-Sex Couple Looks Forward to Legal Marriage

LAS VEGAS --  The Nevada attorney general withdrew support from the state's defense of marriage constitutional amendment on Monday. Catherine Cortez Masto said a recent Ninth Circuit Court of Appeals decision made the state's laws blocking gay marriage impossible to defend.

Sevcik v.Sandoval is the case with eight same-sex couples challenging the constitutionality of Nevada's marriage laws.

Antioco Carrillo and Theo Small met at work. They became friends, started dating, but were told they could never get married.

"I couldn't think of anybody better to go through this journey together," said Carrillo, a plaintiff in the Sevcik v. Sandoval case.

The lawsuit challenges Nevada's ban on same-sex marriage. The Nevada attorney general's decision to give up the defense of those laws has had a big impact on Carrillo's life.

"Now we have to think about planning the wedding really quickly," Carrillo said.

Attorney General Catherine Cortez Masto says the ruling in an unrelated case ruined the state's argument. In that case, the Ninth Circuit Court of Appeals ruled that a juror could not be removed from a trial based on sexual orientation. Cortez Masto says that ruling changed everything.

"The most recent decision that was issued by the ninth circuit completely gutted the state's argument, she said.

Now that Carrillo's main opposition is out of the way, the case can move along quicker.

"There will be oral arguments. If it's expedited, it could be heard much sooner than we think, it all depends on the ninth circuit's timing and court calendar," Cortez Masto said.

Carrillo is excited that he might finally be able to get married.

"I want to be able to say that I had the opportunity to marry the person that I love," he said.

If the ninth circuit does not overturn Nevada's laws blocking gay marriage, voters may get a chance to vote on the issue in Nov. 2016. Legislators approved a resolution to put the matter before voters. They must approve it again in 2015 before it can appear on the ballot
