Court: Dog Owner Can Sue After Police Killed Pets

Posted: Updated:

LAS VEGAS (AP) -- An appeals court says a woman can sue North Las Vegas police for killing two dogs while they executed a search warrant at her home in 2008.

The 9th U.S. Circuit Court of Appeals ruled 2-1 last week that District Judge Larry Hicks was wrong to dismiss Louisa Thurston's civil rights lawsuit.

The judges ruled that there were genuine concerns about whether police acted reasonably in killing dogs Blue and Bruno. They noted that police waited 20 minutes after entering the home before opening fire -- enough time to summon animal control.

The incident happened Feb. 8, 2008, while SWAT officers executed a search warrant on Thurston's husband, who was wanted on armed robbery charges.

North Las Vegas police spokeswoman Chrissie Conn says the department doesn't comment on pending litigation.
