Charges Dropped in Las Vegas Home Pot Growing Case

Posted: Updated:

LAS VEGAS (AP) -- Prosecutors dropped felony drug charges against a Las Vegas man who maintained that his medical marijuana card allowed him to have the 12 pot plants that authorities found in his home in October 2012.

David Silvaggio walked out of Clark County District Court a free man Monday after a judge agreed to dismiss possession of marijuana and possession of a controlled substance with intent to sell charges.

The 50-year-old Silvaggio had faced trial next month and up to four years in prison if he was convicted.

District Attorney Steve Wolfson says the outcome is in the best interest of justice.

The case highlighted conflicts in state medical marijuana law.

Nevada voters approved a constitutional amendment allowing medical marijuana in 2000, but patients have had no legal way to obtain it.
