State High Court Wants Briefs in Las Vegas Hep C Case

Posted: Updated:

LAS VEGAS (AP) -- The Nevada Supreme Court is calling for quick briefings on a request to stop trial for former endoscopy clinic owner Dipak Desai in a 2007 Las Vegas hepatitis C outbreak.

A trio of justices set deadlines Wednesday and Friday for prosecutors and attorney Richard Wright to submit written arguments.

The justices noted that jury selection already began Monday in state court in Las Vegas.

Wright argues that Desai is too incapacitated by strokes to assist in his defense.

Prosecutors allege that Desai is exaggerating his ailments.

Desai and former nurse-anesthetist Ronald Lakeman have pleaded not guilty to charges including murder, fraud and criminal neglect of patients at a Desai clinic where health officials determined nine people contracted incurable hepatitis C in 2007.

One former patient later died.
