DA: Federal Officer's Shooting of a Fugitive Not Criminal

LAS VEGAS -- Clark County District Attorney Steve Wolfson has determined the federal law enforcement officer who shot and killed an Arizona fugitive will not face criminal charges.

The Nevada Fugitive Task Force was conducting surveillance on Thomas Domagala on Sept. 19, 2012 when he exited a home and left in a vehicle. When officers attempted to stop the vehicle, Domagala stopped the car and fled on foot. A U.S. Deputy Marshal encountered Domagala and shot him, killing him.

"Mr. Domagala chose to flee officers and ignored commands to stop running and drop his weapon. He was running, with a gun in his hand, directly at a U.S. Marshal. His actions left the officer no choice but to defend himself, his fellow officers and the citizens in the area," District Attorney Steven Wolfson said.

Domagala has outstanding warrants for several felony crimes in Arizona.

Due to Wolfson's finding, a Police Fatality Public Fact-finding Review will not be conducted in this case.
