8 on Your Side: Man Receives Foreclosure Letter by Mistake

LAS VEGAS - When Jan Visser read a letter he received that stated he was at risk for foreclosure, and a notice of default had been filed, he couldn't believe it.

"I said this guy has got to be nuts," he said.

That's because he's not in foreclosure. Visser moved into his Anthem home six years ago and always makes his payments on time.

"As a matter of fact, we just refinanced at a lower rate, and you can't do that if you are in foreclosure," he said.

He wanted to know why he received the letter, which promised to get him $3,000 to $30,000 and made false accusations.

"I felt immediately it was a scam," he said.

8 on Your Side investigated and contacted Benchmark Investors Group and Property Management - the company that sent the letter. It wasn't a scam at all, but actually a big mistake.

Benchmark representatives claim their marketing company received Visser's address by accident and issued him a formal apology. The company assured Visser he will not be contacted again.

He says he's happy to know someone wasn't trying to scam him or others.

Benchmark representatives told 8 on Your Side approximately 2,000 people received foreclosure letters like the one sent to Visser. As a result of 8 News NOW's investigation, everyone who was unnecessarily contacted was sent an apology letter.
