DA Drops DUI Charge Against Las Vegas Constable

LAS VEGAS -- The Las Vegas constable who claimed his DUI arrest Feb. 12 was a setup will not face criminal charges, Clark County District Attorney Steve Wolfson announced in a statement Friday.

According to the arrest report, Constable John Bonaventura's preliminary breath test showed him over the legal limit. In the statement, Wolfson said Nevada law does not allow the initial breath test to be used as evidence in court.

The breath test that would have been allowed in court as evidence showed he had a blood alcohol content level of 0.069, below the legal limit of 0.08.

"For these reasons I do not believe that this office could prove Mr. Bonaventura's guilt beyond a reasonable doubt," Wolfson said.

Nevada Highway Patrol officials said Bonaventura was arrested after a caller reported an official constable vehicle driving erratically on US 95 near Boulder Highway.

Wolfson said the speeding vehicle might have been another constable office vehicle.
