LAS VEGAS -- The driver accused of crashing into a bus stop and killing four people appeared in a Las Vegas courtroom Wednesday morning for his arraignment which was delayed for a second time.

Gary Lee Hosey, Jr., waived his right to a preliminary hearing. Although Hosey's family has hired a private attorney, the court was told the family can not afford the lawyer. The judge has set a hearing for Nov. 21 to review assigning a public defender to the case.

Hosey is accused of crashing into a bus stop near Decatur Boulevard and Spring Mountain Road on Sept. 13. Four people were killed and seven were injured.

Prosecutors allege Hosey was above the legal limit for alcohol and has used marijuana when he crashed into the bus stop.
