Loved Ones Seek Answers in Bus Stop Crash Deaths

LAS VEGAS -- When 23-year-old Gary Lee Hosey Jr. entered a Clark County courtroom Friday, he stared blankly at the wall and floor.

In the visitor seating area, Nichelle Garner and Sarah Leal wanted to look into the eyes of the man police said killed Johnnie Garner, their mother and friend, respectively.

Garner was one of four people killed when the car Hosey was driving plowed through a bus stop at Spring Mountain Road and Decatur Boulevard last week. Eight people, including Hosey and his four passengers, were injured in the wreck.

Garner and Leal weren't afraid to express their emotions.

"Hurt. Anger," Leal said. "There's the man that took our mom."

While their eyes were fixed on Hosey, he stood motionless, listening to Judge Conrad Hafen set bail at $4 million.

"It's hard to face him," Leal said. "It's hard to see him. It's so hard to face him."

Clark County District Attorney Steve Wolfsen said despite rumors that Hosey's blood alcohol limit was below the legal limit of .08, Hosey will be prosecuted to the full extent of the law.

"That's unacceptable," Wolfson said. "We have people killed and injured as of this man's actions."

The evidence will be presented in a court of law in a preliminary hearing; however, Hosey's defense team will sort through toxicology reports they say might be wrong.

"We're doing everything we can to investigate that," Hosey's attorney, David Figler said. "Certainly we weren't in control of any of the investigation until it came over to us. So we rely on police reports, but we'll have to dig deeper."

Leal and Nichelle Garner's lives will never be the same and they said Johnnie Garner will never be replaced, they said.

"He took four lives and injured numerous others," Leal said. "It could have been prevented."

Leal said if they could confront Hosey themselves, they'd ask him: "Oh, God, why? Honestly, I want to know why. If you weren't drunk, why were you speeding? If you were drunk, why did you get behind the wheel?"

Hosey's preliminary hearing is scheduled for Oct. 19. Hafen is expected to determine whether there's enough evidence to move to trial.
