LAS VEGAS (AP) -- A last-minute order by the Nevada Supreme Court is allowing a former top Las Vegas drug prosecutor to remain out of jail pending challenges of his nine-month sentence for crack possession.

A Tuesday order by the state high court temporarily postponed David Schubert's scheduled Wednesday surrender before Clark County District Court Judge Carolyn Ellsworth.

A new date wasn't immediately set.

The court previously rejected Schubert's claim that the judge was biased against him and abused her discretion at sentencing in February.

Schubert once prosecuted high-profile drug cases, including plea deals with celebrities Paris Hilton and Bruno Mars.

He resigned from the district attorney's office after being arrested in March 2011 with a $40 rock of cocaine and an unregistered handgun in his car. He pleaded guilty last September.

    Las Vegas-- Investigators are looking into what sparked a fire at an apartment complex near Maryland Parkway and Hacienda.The Clark County Fire Department says the blaze started in a garbage can on the east side of the building. A total of five units were affected by smoke and water damage.The Red Cross is assisting one person from one of the units.Arson investigators are looking into the cause, but say there's nothing suspicious about the fire at this time.More>>
