Lawyers for Las Vegas surgeon Dr. Mark Kabins are asking a federal judge to throw out an indictment of Kabins because of news stories and newspaper columns.
Dr. Kabins was indicted in March 2009 in connection with a four year FBI investigation into the so-called Medical Mafia, a group of local doctors and lawyers suspected of conspiring together to rip off their patients and legal clients.
The motion filed on behalf of Kabins accused federal officials of leaking information to I-team Reporter George Knapp. It cites several stories which aired on Channel 8 and columns written by Knapp for Las Vegas City Life newspaper.
According to the motion, the stories must have been based on leaks from the government. Such leaks would constitute a violation of federal rules of criminal procedure, the motion argues. The U.S. Attorneys office has not yet responded to the motion.
