A judge ordered Metro Police to hand over surveillance video of a parking garage where a local woman claims Congressman Jim Gibbons assaulted her.
The allegation has plagued Gibbons' run for governor and is blamed for a slide in his lead over state Senator Dina Titus.

Gibbons says the tape will show he was not in the parking garage near McCormick and Schmick's where Chrissy Mazzeo claims the attack took place.
Police have already said neither Gibbons nor Mazzeo have seen on the tape.
The judge ordered Metro to make a copy of the tape as soon as possible. When they do, that copy will first be made available to Jim Gibbons' attorney Don Campbell and Chrissy Mazzeo's attorney Richard Wright.
The surveillance tapes have been in the hands of Metro Police since Wednesday when investigators started pouring over the nearly 18 hours of surveillance video.
While Gibbons' attorneys are trying to get the tapes released, Chrissy Mazzeo signed papers Monday to re-launch a full investigation. Mazzeo's attorney says the investigation should block the tapes from being released.
Gibbons' attorney believes these allegations were timed to hurt his clients run for governor.
Don Campbell said, "When this happens to you it does not happen just to you. It happens to everybody who knows and trusts you. Your friends, your family. It's an extraordinarly difficult time for anybody being accused of this. We are in a day and age -- and I understand you to put it all out there as a public figure -- but no one anticipates this type of lunacy to be engaged in."
A judge agreed the public has the right to know given the public nature of the allegations and the upcoming elections.
Metro re-interviewed Mazzeo Monday night. They will ask to re-interview Gibbons within the next two days.
No one except Crescent Properties, which owns the garage, and Metro Police has seen the tape. Still, Gibbons says he's not on it because he never went into the garage.

Jim Gibbons spoke out Tuesday morning on a local radio show. The congressman took questions from viewers live on the air on the Alan Stock and Kerri Kasem show on KXNT.
Gibbons said, "Sometimes you have to fight back fight back to save your reputation and your good name. That's what I'm doing. I'm fighting back now. My life has been an open book for most of my adult life and certainly for the amount of time I've spent in public service, but I've learned that politics can have an ugly side to it and this certainly is one of those times where it has a very ugly side to it."
Congressman Gibbons says he is looking forward to the investigation moving forward and his name being cleared so that he can get back to talking about the issues.
